1. Bendrosios nuostatos

1.1. Šios prekių pirkimo – pardavimo taisyklės (toliau – Taisyklės), jas patvirtinus Pirkėjui (susipažinus su Taisyklėmis bei pažymėjus varnelę prie teiginio „Perskaičiau ir sutinku su Taisyklėmis ir sąlygomis“), yra šalims privalomas teisinis dokumentas, kuriame nustatomos Pirkėjo ir Pardavėjo teisės bei pareigos, prekių įsigijimo bei apmokėjimo už jas sąlygos, prekių pristatymo ir grąžinimo tvarka, šalių atsakomybė bei kitos su prekių pirkimu – pardavimu “kristinalieb.com” internetinėje parduotuvėje susijusios nuostatos.

1.2. Pardavėjas pasilieka teisę, bet kuriuo metu pakeisti, pataisyti ar papildyti Taisykles. Apie bet kokius pakeitimus, pataisymus ar papildymus prisiregistravę Pirkėjai bus informuojami prisijungimo “kristinalieb.com” puslapyje metu ir privalės iš naujo patvirtinti Taisykles. Taisyklių pakeitimas galioja tik tų užsakomų prekių atžvilgiu, kurioms užsakymas buvo pateiktas po Taisyklių pakeitimo.

1.3. Pirkti “kristinalieb.com” el. parduotuvėje turi teisę:

1.3.1. veiksnūs fiziniai asmenys, t.y., asmenys sulaukę pilnametystės, kurių veiksnumas nėra apribotas teismo tvarka;

1.3.2. nepilnamečiai nuo 14 iki 18 metų amžiaus, tik turėdami tėvų arba rūpintojų sutikimą, išskyrus tuos atvejus, kai jie savarankiškai disponuoja savo pajamomis;

1.3.3. juridiniai asmenys;

1.3.4. visų aukščiau nurodytų asmenų įgaliotieji atstovai.

1.4. Pardavėjas, patvirtindamas taisykles, taip pat garantuoja, kad, remiantis taisyklių 1.3. punktu, Pirkėjas turi teisę pirkti prekes el. parduotuvėje.

1.5. Sutartis tarp Pirkėjo ir Pardavėjo laikoma sudaryta nuo to momento, kai Pirkėjas el. parduotuvėje suformavęs prekių krepšelį, nurodęs pristatymo adresą, pasirinkęs atsiskaitymo būdą ir susipažinęs su Pardavėjo taisyklėmis, paspaudžia mygtuką „Pirkti“.

2. Pirkimo – pardavimo sutarties įsigaliojimas

2.1. Sutartis tarp Pirkėjo ir Pardavėjo laikoma sudaryta nuo to momento, kai Pirkėjas, išsirinkęs perkamą(as) prekę(es) ir suformavęs prekių krepšelį, paspaudžia nuorodą „Pirkti“.

2.2. “kristinalieb.com” nėra įsipareigojęs atskirai pranešti Pirkėjui apie savo sutikimą sudaryti sutartį. Laikoma, kad “kristinalieb.com” patvirtina užsakymą nuo momento, kai pradeda jį vykdyti.

2.3. Kiekviena tarp Pirkėjo ir Pardavėjo sudaryta pirkimo – pardavimo sutartis yra registruojama ir saugoma “kristinalieb.com” internetinės parduotuvės duomenų bazėje.

3. Prekių kainos, apmokėjimo tvarka ir terminai

3.1. Prekių kainos internetinėje parduotuvėje ir suformuotame užsakyme nurodomos eurais.

3.2. Sutartis pradeda galioti nuo to momento, kai Pirkėjas paspaudžia mygtuką „Pirkti“, o gavęs užsakymą Pardavėjas jį patvirtina, atsiųsdamas patvirtinimo laišką Pirkėjo nurodytu el. paštu.

3.3. Pirkėjas įsipareigoja už prekes sumokėti nedelsiant. Tik gavus apmokėjimą už prekes, pradedamas formuoti prekių siuntinys ir pradedamas skaičiuoti prekių pristatymo terminas.

4. Prekių pristatymas

4.1. Prekes pristato Pardavėjas arba jo įgaliotas atstovas.

4.2. Pardavėjas įsipareigoja pristatyti prekes Pirkėjui, laikydamasis prekių aprašymuose ir skiltyje pristatymas ir grąžinimas nurodytų terminų. Šie terminai netaikomi tais atvejais, kai Pardavėjo sandėlyje nėra reikiamų prekių, o Pirkėjas informuojamas apie jo užsakytų prekių trūkumą. Kartu Pirkėjas sutinka, jog išimtinais atvejais prekių pristatymas gali vėluoti dėl nenumatytų aplinkybių.

4.3. Pirkėjas, užsakydamas prekes, įsipareigoja nurodyti tikslią prekių pristatymo vietą.

4.4. Pirkėjas įsipareigoja prekes priimti pats. Tuo atveju, kai jis prekių pats priimti negali, o prekės pristatytos nurodytu adresu ir remiantis kitais Pirkėjo pateiktais duomenimis, Pirkėjas neturi teisės reikšti Pardavėjui pretenzijų dėl prekių pristatymo netinkamam subjektui.

4.5. Tuo atveju, kai Pirkėjas, remdamasis šiomis Taisyklėmis, atsisako pirkimo – pardavimo sutarties, jam tenka pareiga apmokėti visas tiesiogines prekių grąžinimo Pardavėjui išlaidas.

4.6. Jei nėra galimybės užsakytų prekių pristatyti viena siunta, tai “kristinalieb.com” turi teisę pristatyti prekes keliomis siuntomis.

4.7. Visais atvejais Pardavėjas atleidžiamas nuo atsakomybės už prekių pristatymo terminų pažeidimą, jeigu prekės Pirkėjui nėra pristatomos arba pristatomos ne laiku dėl Pirkėjo kaltės arba dėl nuo Pirkėjo priklausančių aplinkybių.

5. Prekių kokybė, garantija

5.1. Kiekvienos “kristinalieb.com” parduodamos prekės savybės bendrai nurodomos prie kiekvienos prekės esančiame prekės aprašyme.

5.2. Pardavėjas neatsako už tai, kad internetinėje parduotuvėje esančios prekės savo spalva, forma ar kitais parametrais gali neatitikti realaus prekių dydžio, formų ir spalvos dėl Pirkėjo naudojamo vaizduoklio ypatybių.

6. Prekių grąžinimas ir keitimas

6.1. Prekių grąžinimo ir keitimo numatyta teise Pirkėjas gali pasinaudoti per 14 (keturiolika) dienų nuo prekių pristatymo dienos.

6.2. Grąžinama prekė turi būti nedėvėta, originalioje tvarkingoje pakuotėje, Pirkėjo nesugadinta, nepraradusi prekinės išvaizdos (nepažeistos, nenuplėštos etiketės), (šis punktas netaikomas tuo atveju, kai grąžinama nekokybiška prekė)), tos pačios komplektacijos, kokios buvo Pirkėjo gauta.

6.3. Tuo atveju, kai prekė grąžinama remiantis 6.1. punkte numatyta teise, Pirkėjui tenka prekių grąžinimo išlaidos. Kai grąžinama gauta ne ta prekė ir/ar nekokybiška prekė, Pardavėjas įsipareigoja pasiimti tokias prekes ir jas pakeisti analogiškomis tinkamomis prekėmis. Tuo atveju, kai Pardavėjas neturi analogiškų prekių, jis grąžina Pirkėjui už prekes sumokėtus pinigus ne vėliau kaip per 14 darbo dienų.

6.4. Pardavėjas turi teisę nepriimti Pirkėjo grąžinamų prekių, jei Pirkėjas nesilaiko šiame straipsnyje ir dalyje – Prekių grąžinimas – nustatytos prekių grąžinimo tvarkos.

7. Atsakomybė

7.1. Pirkėjas yra visiškai atsakingas už registracijos formoje pateiktų duomenų teisingumą. Jei Pirkėjas nepateikia registracijos formoje tikslių duomenų, Pardavėjas neatsako už dėl to atsiradusius padarinius.

7.2. Pirkėjas atsako už veiksmus, atliktus naudojantis šia internetine parduotuve.

7.3. Pirkėjas atsako už savo prisijungimo duomenų perdavimą tretiesiems asmenims. Jei “kristinalieb.com” teikiamomis paslaugomis naudojasi trečiasis asmuo, prisijungęs prie internetinės parduotuvės naudodamasis Pirkėjo prisijungimo duomenimis, Pardavėjas šį asmenį laiko Pirkėju.

7.4. Pardavėjas atleidžiamas nuo bet kokios atsakomybės tais atvejais, kai nuostoliai kyla dėl to, jog Pirkėjas, neatsižvelgdamas į Pardavėjo rekomendacijas ir savo įsipareigojimus, nesusipažino su šiomis Taisyklėmis, nors tokia galimybė jam buvo suteikta.

7.5. Jei Pardavėjo internetinėje parduotuvėje yra nuorodos į kitų įmonių, įstaigų, organizacijų ar asmenų tinklapius, Pardavėjas nėra atsakingas už ten esančią informaciją ar vykdomą veiklą, tų tinklapių neprižiūri, nekontroliuoja ir toms įmonėms bei asmenims neatstovauja.

7.6. Atsiradus žalai, kaltoji šalis atlygina kitai šaliai atsiradusius tiesioginius nuostolius.

8. Apsikeitimas informacija

8.1. Pardavėjas visus pranešimus siunčia Pirkėjo registracijos formoje pateiktu elektroninio pašto adresu.

8.2. Pirkėjas visus pranešimus ir klausimus siunčia Pardavėjo internetinės parduotuvės skyriuje „Kontaktai“ nurodytomis susisiekimo priemonėmis.

9. Baigiamosios nuostatos

9.1. Šios prekių pirkimo – pardavimo Taisyklės sudarytos vadovaujantis Lietuvos Respublikos įstatymais ir kitais teisės aktais.

9.2. Visi nesutarimai, kilę dėl šių Taisyklių vykdymo, sprendžiami derybų būdu. Nepavykus susitarti, ginčai sprendžiami Lietuvos Respublikos įstatymų nustatyta tvarka.

10. Nuosavybės aktas

10.1. Internetinė svetainė www.kristinalieb.com priklauso UAB „Lorėja“, kuri įsikūrusi Žvaigždynų 25, Lelių k., Klaipėdos raj., LT-91277, Lietuva. Įmonės kodas: 302802354.

PRIVATUMO POLITIKA:

1. 1. Asmens duomenų apsauga

1.1. Pirkėjas, užsakydamas prekes, atitinkamuose Pardavėjo pateikiamuose informacijos laukuose turi nurodyti prekių užsakymo tinkamam įvykdymui būtinus Pirkėjo asmens duomenis: vardą, pavardę, prekių pristatymo adresą, telefono numerį ir el. pašto adresą. Pardavėjas ”kristinalieb.com” taip pat turi teisę naudoti Pirkėjo asmens duomenis reklamos ir informacijos pateikimo Pirkėjui tikslais “kristinalieb.com” veiklos ribose.

1.2. Pirkėjas sutinka, kad “kristinalieb.com” el. parduotuvėje duomenys tokie, kaip IP adresas, prisijungimo data ir vietovė, tinklapis ir naršyklė, iš kurio buvo prisijungta, įrenginys ir įrenginio operacinė sistema, iš kurio buvo prisijungta, ir pirkimo veikla (prekės, jų kiekis, krepšelio dydis) bus kaupiami Google Analytics pagalba.

1.3. Patvirtindamas šias taisykles Pirkėjas sutinka, jog 1.1. ir 1.2. punkte pateikti Pirkėjo asmens  duomenys būtų tvarkomi prekių ir paslaugų pardavimo “kristinalieb.com” el. parduotuvėje, Pardavėjo veiklos analizės, tiesioginės rinkodaros tikslais ir esant būtinybei, atskleisti juos tretiesiems asmenims, kai tai būtina užsakymo įvykdymui, duomenų tvarkymui arba “kristinalieb.com” veiklos planavimui ir analizei.

1.4. Sutikdamas, kad Pirkėjo asmens duomenys būtų tvarkomi prekių ir paslaugų pardavimo Pardavėjo “kristinalieb.com” el. parduotuvėje tikslu, Pirkėjas taip pat sutinka, kad Pirkėjo nurodytu el. pašto adresu ir/ar telefono numeriu būtų siunčiami informaciniai pranešimai, būtini prekių užsakymui įvykdyti. Pirkėjas užsisakęs naujienlaiškį ir kitus pranešimus gaunamus per el. paštą, turi pasirinkimą naujienlaiškį atsisakyti, naujienlaiškio apačioje paspaudęs ant nuorodos “Atsisakyti”.

1.5. Pirkėjas, užsiregistruodamas “kristinalieb.com” el. parduotuvėje bei užsakydamas prekes, įsipareigoja saugoti ir niekam neatskleisti prisijungimo duomenų.

2. Pardavėjo taikomos rinkodaros priemonės

2.1. Pardavėjas savo nuožiūra gali inicijuoti įvairaus pobūdžio akcijas “kristinalieb.com” internetinėje parduotuvėje ir “kristinalieb.com” paskyroje, esančioje socialiniame tinklalapyje Facebook, Instagram bei kitose informacinėse priemonėse.

2.2. Inicijuodamas tam tikras akcijas, tokiose akcijose nurodytomis sąlygomis, Pardavėjas gali suteikti Pirkėjams virtualių “kristinalieb.com” nuolaidų kodą, kuriuo galima gauti nuolaidas už internetinėje parduotuvėje “kristinalieb.com” įsigyjamas prekes.

2.3. Pardavėjas turi teisę, prieš tai informavęs pirkėjus, savo vienašališku sprendimu pakeisti akcijų sąlygas, taip pat jas panaikinti, pakeisti “kristinalieb.com” nuolaidų kodo suteikimo ir jo panaudojimo, atsiskaitant už prekes tvarką. Bet kokie Pardavėjo inicijuojami akcijų, sąlygų ir “kristinalieb.com” nuolaidų kodo suteikimo bei panaudojimo tvarkos pakeitimai (įskaitant panaikinimą) taikomi tik į ateitį, t.y. galioja nuo jų atlikimo momento.

2.4. Specifinės tam tikrų Pardavėjo inicijuojamų akcijų sąlygos, būdingos tik toms konkrečioms akcijoms, apibrėžiamos šių akcijų komunikacinėse priemonėse.

3. Slapukai ir jų naudojimas

3.1. kristinalieb.com el. parduotuvė naudoja slapukus. Slapukas – tai mažas tekstinis dokumentas, turintis unikalų identifikacijos numerį, kuris yra perduodamas iš svetainės į lankytojo kompiuterį, kad el. parduotuvės moderatorius galėtų atskirti lankytojo kompiuterį ir matyti jo veiklą. Slapukai talpina tik tekstinę informaciją ir neperteikia jokių virusų.

3.2. Pirmojo tipo slapukai naudojami naršymo informacijai saugoti. Jie nustoja veikti pasibaigus apsilankymo seansui.

3.3. Antrojo tipo slapukai naudojami stebėti vartotojų elgseną. kristinalieb.com el. parduotuvėje šio tipo slapukas naudojamas stebėti pirkinių krepšelio veiklą ir lankytojų statistiką. Pirkėjas turi teisę slapukų atsisakyti ir išjungti, tačiau tuomet gali neveikti kai kurios puslapio funkcijos.

1. General provisions

1.1. These Rules of Purchase and Sale of Goods (hereinafter referred to as the Rules), upon their approval by the Buyer (following the Rules and accepting the „I have read and agree to the Terms and Conditions“), is a legal document binding on the parties, specifying the rights and obligations of the Buyer and Seller, terms of purchase and payment for goods, order of delivery and return of goods, liability of the parties, and other provisions related to the sale of goods in the kristinalieb.com online store.

1.2. The seller keeps the right to change, correct or supplement the Terms and Conditions at any time. Buyers will be notified to the login page of „kristinalieb.com“ about any changes, corrections or additions to the Terms and Conditions and will need to re-approve those. The change of rules is valid only for those ordered goods for which the order was submitted after the change of the Rules.

1.3. Allowed to shop at kristinalieb.com online store are:

1.3.1. Active natural persons, i.e., persons who have reached the age of majority, whose capacity is not restricted by law;

1.3.2. Minors aged between 14 and 18, only with the consent of parents or carers, except when they are self-disposing of their income;

1.3.3. Legal entities;

1.3.4. Authorized representatives of all the above-mentioned persons.

1.4. The Seller approving the rules, also guarantees that, in accordance with Rule 1.3., the Buyer has the right to purchase goods in the online store.

1.5. The agreement between the Buyer and the Seller will be considered as concluded from the moment when the Buyer clicks on the button „Buy“ after entering the shopping cart, indicating the delivery address, selecting the payment method and accepting Seller’s terms and conditions.

2. Purchase agreement

2.1. The agreement between the Buyer and the Seller is considered to be concluded from the moment when the Buyer chooses the purchased item(s), has formed a basket of goods, and has clicked the button „Buy“.

2.2. „kristinalieb.com“ is not obliged to inform the Buyer separately about its agreement to conclude a contract. It is considered, that kristinalieb.com approves the order from the moment it is executed.

2.3. Each Purchase Agreement concluded between the Buyer and Seller is registered and stored in the database of kristinalieb.com online store.

3. Prices of goods, payment order and terms

3.1. The prices of goods in the online store are indicated in euros.

3.2. The Agreement is valid from the moment when the Buyer clicks on the Buy button. The Seller confirms it by sending a confirmation letter to the e-mail address indicated by the Buyer.

3.3. The buyer undertakes to pay the goods immediately. Only upon receipt of payment for the goods, the order will be set for shipmen and the delivery period of the goods starts to run.

4. Delivery of goods

4.1. Goods are delivered by the Seller or his authorized representative.

4.2. The Seller undertakes to deliver the goods to the Buyer in accordance with the terms specified in the product descriptions or in the section delivery and return. These terms do not apply in cases when ordered goods are not available in the warehouse. In that case the Buyer will be informed about the lack of goods ordered by him. At the same time, the Buyer agrees that, in exceptional cases, the delivery of the goods may delay due to unforeseen circumstances.

4.3. The buyer, when ordering the goods, undertakes to indicate the exact place of delivery of the goods.

4.4. The buyer undertakes to accept the goods himself. In the case that the Buyer is not able to accept the goods by himself and the goods are delivered to the indicated address, the Buyer is not entitled to claim regarding the delivery of the goods to another entity.

4.5. In the event that the Buyer, on the basis of terms and conditions, refuses the contract of Purchase, he is obligated to pay all direct costs of returning the goods to the Seller.

4.6. If there is no possibility to deliver ordered goods in one shipmen, kristinalieb.com has the right to deliver goods in several shipments.

4.7. The Seller is released from liability for violation of delivery terms in all cases, if the goods are not delivered to the Buyer or delivered with a delay due to the fault of the Buyer or due to circumstances caused by the Buyer.

5. Product quality, warranty

5.1. The features of each item sold in the online store kristinalieb.com are described in the product description.

5.2. The seller is not responsible for the fact that the goods in the online store may not correspond to the actual size, shape and color of the goods in their color, form or other features due to the monitor used by the Buyer.

6. Return and replacement of goods

6.1. The Buyer can use the right for returns and replacements of goods within 14 (fourteen) days from the date of delivery of the goods.

6.2. The returned item must be in the original order packaging, not damaged by the Buyer, with its original appearance (undamaged, undisputable labels), (this does not apply in case of returning a defective product), the same items as received by the Buyer.

6.3. In the case of a return of goods on the basis of 6.1. the Buyer has to cover the costs for the return. In case the Buyer receives damaged items, the Seller undertakes to take such goods and replace them with not damaged goods. If the Seller does not have the same goods, he returns to the Buyer the money paid for the goods not later than within 10 business days.

6.4. The Seller has the right not to accept goods returned by the Buyer if the Buyer does not follow the terms and conditions for the return of goods specified in this article.

7. Responsibility

7.1. The Buyer is solely responsible for the accuracy of the data provided in the registration form. If the Buyer fails to submit accurate data in the registration form, the Seller is not liable for the resulting consequences.

7.2. The Buyer is responsible for the actions taken in the kristinalieb.com online store.

7.3. The Buyer is responsible for transferring his/her login data to third parties. If the online store kristinalieb.com is being accessed by a third party using the customer’s login data, the Seller considers this person as a Buyer.

7.4. The Seller is exempted from any liability in cases where the loss arises from the fact that the Buyer, despite the Seller’s recommendations and obligations, did not read these terms and conditions, although such an opportunity was granted.

7.5. The Seller is not responsible for the information or activities in websites of other companies, institutions, organizations or individuals, that are referred in the online store. The Seller does not oversee, control or represent these companies, institutions or individuals.

7.6. In case of damage, the damaged party compensates for direct losses incurred to the other party.

8. Exchange of information

8.1. The seller sends all messages and necessary information to the e-mail address provided by the Buyer.

8.2. The Buyer sends all messages and questions to the e-mail address provided by the Seller in the „Contacts“ section of the online store.

9. Final provisions

9.1. These terms and conditions for the purchase goods are concluded in accordance with the laws and other legal acts of the Republic of Lithuania.

9.2. All disputes arising from the execution of these terms and conditions will be resolved by negotiation. Failing to reach an agreement, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.

10. Ownership Act
